Recently, the case of copyright infringement dispute brought by Hytek Power Co., Ltd. (hereinafter referred to as "Hytek") against a hydraulic company in Shenzhen was finally concluded by the final judgment of the Shenzhen Intermediate People's Court of Guangdong Province. The defendant was ordered to immediately cease the infringement, delete the videos that infringed Hytek's copyright, and compensate Hytek for economic losses and legal enforcement expenses.
The judgment reaffirms our belief:
Innovation deserves respect, and infringement will ultimately come at a cost.
I. Videos crafted with care should not be "taken without permission"
The videos in question are product promotional videos for Hytek's "piston pump/motor series products," to which Hytek holds the copyright. Over the years, Hytek has maintained a high level of R&D investment, established dedicated technical task forces, and continuously iterated and optimized its piston pump/motor series products. These promotional videos are a vivid embodiment of our philosophy that "R&D drives products, and products reinforce the brand."
However, in 2025, Hytek discovered that a Shenzhen-based hydraulic company, without obtaining proper authorization, had arbitrarily published Hytek's promotional videos for the "piston pump/motor series products" (hereinafter referred to as the "infringing videos") on its corporate-certified Douyin account. Not only did the defendant fail to attribute the source of the infringing videos, but it also blatantly superimposed its own brand name and trademark onto the videos to mislead the public, using them for its own product promotion and commercial traffic generation. Such "copy-and-paste" behavior not only infringes upon our legitimate rights and interests but also shows a fundamental disrespect for the spirit of originality.
II. Taking proactive action – protecting our rights is not making a mountain out of a molehill
Upon discovering the infringement, Hytek did not remain silent. Instead, we promptly secured the evidence and filed a lawsuit. Some may ask: "Was that really necessary?" Our answer is: Yes, it was – and it is absolutely essential.
We are fully aware that in the industrial manufacturing sector, every piece of technical data and every frame of promotional content represents substantial financial investment and countless hours of meticulous work. Allowing infringers to "free-ride" would not only discourage innovators but also foster unhealthy practices across the industry.
Therefore, our goal in enforcing our rights is by no means limited to obtaining compensation. It is also to send a clear signal to the industry: Hytek respects every intellectual achievement and will never tolerate any form of infringement.
III. A final judgment in our favor, but we will not stop here
The court of second instance upheld the first-instance judgment, ordering the Shenzhen-based hydraulic company to immediately cease the infringement, delete the infringing videos, and compensate Hytek for its economic losses. Although the amount of damages awarded was not our primary pursuit, the court's supportive stance has greatly encouraged us – it demonstrates that the judiciary provides tangible protection for innovative achievements.
We believe that this ruling is not only a endorsement of Hytek, but also an encouragement to all manufacturing enterprises that insist on originality and value R&D, and above all, a strong deterrent against unlawful infringement.
